Google Commissioned Report Aims to Protect Search Engine Free Speech Rights

Search engine results are a form of opinion; companies like Google offer information they think is most relevant to users. In addition, Google and other search engines are media enterprises, just as much as The New York Times or CNN, and therefore deserve the same free speech protections.

Though search results are selected and sorted according to a computerized algorithm, search engineers influence that algorithm, exercising a form of editorial judgment, says a new report commissioned by Google. From the outset, its purpose is clear: in drawing comparisons to newspapers and other media outlets, scholar Eugene Volokh makes the case against government intervention in search results with a compelling argument to protect the search giant’s First Amendment rights.

First Amendment Protection for Search Engine Search Results, released in mid-April, is the work of UCLA law professor Volokh. That this is Google’s position now might surprise some, as they’ve flip-flopped back and forth – think back to various cases over the last decade in which Google was forced to defend their search results as unbiased and free of manual influence.

“We believe that the subjective judgment of any individual is, well … subjective, and information distilled by our algorithms from the vast amount of human knowledge encoded in the web pages and their links is better than individual subjectivity.” – Google Fellow Amit Singhal, 2008

“At Google we do not manually change search results… we have to find what weakness in the algorithm caused [an unsatisfactory] result and find a general solution to that, evaluate whether a general solution really works and if it’s better, and then launch a general solution. That makes the process slower, but it puts a lot more discipline on us and makes it more unbiased.” – Google VP for Search Quality Udi Manber, 2008

Google treads a thin line that seems to sway just a little from side to side, as circumstances dictate. They’ve had to argue the integrity of their algorithm while protecting their right to do with it as they please for years, more notably in the SearchKing and Kinderstart cases. Can a search algorithm be completely objective while claiming First Amendment protection on the grounds of their use of editorial judgment?

It’s an age-old question and one that won’t be solved by the end of this article. It will, however, be an interesting situation to watch, especially as the commissioning of the paper may indicate Google is preparing for another round of antitrust defense.

The paper’s comparison to The New York Times and other media outlets is a particularly interesting one. At a newspaper, content is not included unless it passes a very human editorial process – there is one editor-in-chief and the buck stops there.

Search engines index all content they can find through crawling the web; the human editorial process is not in selection, but in ranking and sorting. There is a secondary human editorial process in the webspam team, who can choose to remove a website from the index entirely if it falls outside of their guidelines (and this comes to their attention). In this sense, Google’s is a reverse editorial process.

The Google+ Revolution

Google, the Internet giant launched yet another social network, the Google+. After failures of Orkut, Wave and Buzz, Google has now come up with a new glamorous Google+ which to a most people is a combination of the twitter and facebook.

The other day I saw this picture on the Internet and in reality, Google has got it all.

I am not here to boast about the Google supremacy over the Internet, but to consider and examine that what it is that it has still missed and how it aims to achieve it, monetarily and in terms of its command over the Internet.

At the moment a Google+ profile looks cleaner than any of our other social networks, but so did any one of them when they started. So it is just like the honey comb as it grows and grows the fruit is going to be as much. It is quite clear that wherever the users go, the marketers would follow.

Google probably has access to any data that is needed to deduce market insights, business futures or any other estimation or analysis needed for any business to progress in the right direction. But it is the new more interactive and engaging social media data that is driving business decisions these days. What people are saying? What they are propagating? What do they think? What do they want? How do they want it? All these questions are answered directly by the new engaging social media.

Facebook’s New Announcement: Awesome New Features

Facebook introduced video calling, group chat and a new design on Wednesday during the social network’s much-heralded “awesome” announcement. Wearing his signature grey t-shirt and blue jeans, Facebook’s founder Mark Zuckerberg announced the features at a press conference in Palo Alto, Calif.


Facebook Video Calling was developed with Skype, the world’s largest Internet phone company.

Users with a webcam on their computer will have to install a special plug-in before they can make calls using Facebook from inside their web browser. Callers will be able to see and hear the recipient, and vice-versa. With the group chat feature, users can talk with several other Facebook friends at the same time using only text.

“We think this is going to be something that’s really valuable,” Zuckerberg said. “A lot of people have asked for it.”

Group video calling is not yet supported and it was not clear how the feature would be available to mobile users. Zuckerberg said the new tools “are mostly web features.” The design changes are aimed to make it easier for users to see a list of friends they can chat with, while taking advantage of widescreen computer displays. Wednesday’s announcement from Facebook comes almost a week after Google launched its latest social network, Google+.

Google+ is accessible on an invite-only basis, but the company is keen to get a foothold in the social networking sector. The new service has been received with mostly positive reviews, earning praise for its Circles and Hangouts features. Circles lets users easily drag-and-drop contacts into groupings with customizable security and privacy settings. Hangouts, meanwhile, lets users chat and collaborate in realtime using webcams. Users may also collectively watch videos on YouTube.

Before the Facebook announcement today, analysts speculated the deal between Facebook and Skype could be a reaction by Facebook to try and quickly add the features it’s currently missing when compared to Google+. With all these new reasons to use social media it a plus for business.

Social Media Buzzwords

As we cope with and revel in a new business environment – with opportunities and challenges we’ve never faced before – we’re also busy developing a new language to describe that environment and those channels and conditions. Unfortunately, the language of social media sounds almost as buzzy and insincere as those cringe-worthy business terms we see used in so many presentations and business documents. How many times have you heard about the “holistic” business approach used to “leverage” “best practices”? Too many, whatever your answer might have been.

Due to the fact that social media environments, tools, and experience are all relatively new to us, they test our ability to describe the phenomena using only our pre-existing vocabulary. We’ve now invented a new language to describe this powerful force, and some of it is as colorful and passionate as the channel itself. From the right source, with thoughtful use, words can relay specific and purposeful information. Common words like transparency, engagement, authenticity, and viral are examples of buzz-endangered terms that succinctly convey important concepts newly applied to business circumstances but are often misused or misapplied. They are overused and have become buzzwords that lose meaning or credibility, or both.

Who is the Source? Who is Listening?

The buzz factor relates directly to the credibility of the user throwing the term around as well as the depth of knowledge of the people in the conversation. Many people hide behind phrases when they don’t have a firm grasp on the concepts. When used appropriately, these same words also describe new phenomena or provide a useful linguistic shortcut to describe complex ideas.

When someone describes a “troll” or refers to “the social graph” or a “tag cloud” in social media, if you know the field you know exactly what they mean without the need for additional explanation. Those not on the professional side of this industry simply shake their head and wonder what we’re talking about. Of course, every field has their insider language and social media is not unique in this. I would certainly be as lost in a conversation with physicists, engineers, artists, or doctors as they would be in our conversation, but it would not be likely to come up because I don’t dabble in black holes or new radiology techniques, while they likely participate to one degree or another in social media and can claim familiarity from a user’s perspective.

Generally, these terms fall into a few distinct categories. There are familiar words that take on new or related meanings in social media context, for example “like,” “real time,” or “sentiment.” There are new words to describe new products or business models like “ebook” or “wiki,” as well as those that support new communication modes like “blog” or “hash tag.”

Sometimes the words or phrases are simply descriptive and combine two concepts in a new way to mimic the combination of the actual functions. “Social search” combines traditional search algorithmic results with friend data and other information from social networking sites to deliver intuitive and relevant search results. “Social gaming” combines casual and other gaming opportunities with shared experiences or in shared environments. “Social shopping,” “social commerce,” and “social CRM” join a long list of other online behaviors finding their way into social environments. With each new possibility, a new term is born.

Out with the Old in with the New

In an industry that is rapidly evolving, it’s no surprise that the language feels new and may be subject to interpretation and misuse for a bit of time. Like a new toy, they are getting a lot of use and attention right now, but it would be better if we thought of them as tools, not toys. The trade words have meaning and are useful when used in context and judiciously. They should not be used to exclude and confuse, but to make thing clear.
